No question in my mind that legally, it would be best for him to drop out instead of facing that hearing. The problem is what the NFL's perception would be if he did that.
He could take the John Gault approach and not participate, forcing the university to make the decision. If he comes to the conclusion that he should leave FSU, he should make them make the move, so it doesn't look like he left anyone. He could make a simple statement that he has broken no laws, has been charged with no crimes by the state of Florida, so this move by FSU is a witch hunt designed to hurt him, and that he will not participate. Then FSU has to decide if they want to throw away their chance at another national champioship and look bad (to some people) by kicking him out of school for something he has never been charged with. It might be his only way to "look better" by making FSU look like the bad guy...at least a little bit. Denial in the face of apparent truth has worked for tons of high profile people, who continue in their career paths. Owning up to something usually hurts you more. Hate to break up silliness here but his actual lawyer was on tv yesterday. Seems pretty clear he won't let thus hearing actually happen until after season. At which point he will chuck the deuces and leave school for draft.
